I write to you in regard to the vending bills that are before the Consumer Affairs Committee.

The existing vending laws are more than sufficient to maintain the public interest in safe streets.
If there is a vending problem that needs to be addressed, all that is required is to enforce the existing laws.

Intro #828: I understand that there is an issue with a vendor of written matter in CM Brewer’s district. The existing laws specifically prohibit this, and with proper enforcement, the problem could be solved. To punish all vendors citywide for the violations of a single vendor is heavy-handed and unfair.

Intro #830 is a transparent attempt by Councilmember Gerson and the BIDs to severely and
arbitrarily limit the free speech rights of visual artists.

Intro #832 is a key part of CM Gerson’s “rid the streets of all vendors” plan, by eliminating the small number of legal vending spaces currently in existence. As the city deliberately clutters the sidewalks with objects literally bolted to the ground via the Street Furniture Initiative, this law will make it impossible for vendors to set up legally.

Intro # 846: Business Improvement Districts should not be in a position of authority regarding vendors, particularly 1st Amendment protected vendors.
